How to Enter and Stay in Italy

Italy – if you want to be living la dolce vita, you need to know what visas and permits are required.

To become an expat living in Italy, as with living in any country around the world that you’re not a national of, you have to apply for the appropriate legal documents.

Whilst this seems like a daunting task at the outset, once you know the reasons and circumstances of you wanting or requiring to stay and live in Italy, the relevant path for you to take becomes reasonably clear.

This is the first of a 4-part introduction to helping you to navigate the legal road to your Italian destiny.

So, here are the basic rules to follow that should at least help you to determine your starting point for commencing the initial application process.

1. Do you intend to stay in Italy for less than three months (90 days)?

If you intend to stay for less than three months (90 days), you are deemed to be a tourist, irrespective of the reason for being in Italy.

For example, if you are going to be in Italy on holiday, or on a short business or professional secondment, or studying, then you will be treated as a tourist.

And this applies if you live in the EU, for example the UK, Ireland, Germany, France, Spain, Holland, Denmark and many others, and if you are a citizen of a country outside of the EU, such as Australia, New Zealand, USA and Canada to name just a few.

If you end up staying, or intend to stay for more than 3 months, then the issue of you currently being either an EU national or a non-EU national comes into play….

2. Are you an EU national?

If you are, then you require a tourist visa.

This is granted to citizens in most countries in the EU as a consequence of the Schengen Treaty.

To stay longer than three months you need to register with your local Anagrafe (registry) office at the local town hall, and provide the following documents as proof of:

(1) Identity.
(2) Employment or self-employment or sufficient financial resources.
(3) Enrolment in an educational facility together with sufficient financial resources.
(4) Valid health insurance

Note: EU nationals do not need the Stay Permit or Residency documents (which we’ll cover in a later video in this series) if they wish to live in Italy.

3. Are you a non-EU national?

If you are, and you stay, or intend to stay in Italy, longer than 3 months (90 days), then the following options are available:

Timing can be crucial here, depending on your current circumstances, especially if you’re currently in Italy, and you now want to stay for longer than the initial three months (90 days), so take note so that you can put the wheels in motion sooner, rather than later.

Firstly, you have to obtain a Permit to Stay within the first eight days of arrival.

Therefore, after the initial three months, visitors must acquire a “Non-Tourist” visa.

Here’s the spanner that gets thrown into the works - you need to apply for the “Non-Tourist” visa in your home country.

Here’s the golden rule to remember in the whole of this process:

A visa (and a valid passport) allows you ENTRY into Italy.

The Permit to Stay (Permesso di Soggiorno) allows you to STAY in Italy.

Note: If you have acquired Italian citizenship by descent or by marriage, you may not require a visa.
