With Joan Rivers' tragic death, many people want to know what is 'pecuniary loss' in a wrongful death case here in New York?

When a surviving family brings a lawsuit claiming that their family member suffered an untimely death because of a doctor's carelessness, one element of damages is known as “pecuniary loss.”

There are different types of compensation a surviving family can claim in a wrongful death lawsuit.

Pecuniary losses really relate to the amount of money that the family has lost as a result of their loved one's death.

As a result of an untimely death, that person can no longer contribute their financial resources to the family for their support and day-to-day function.

If the wrongful death case goes to trial and the jury determines that a doctor or hospital violated the basic standards of medical care and that those departures from good medical practice caused or contributed to her injuries and untimely death, then the jury is legally obligated to give compensation to the surviving family.

2 DIFFERENT TYPES OF COMPENSATION...

There are basically two different types of money that are given in this scenario. The first is called “economic loss.” The second is called “non-economic loss.”

ECONOMIC LOSS...

Economic loss is really the amount of money the family has lost as a result of their family members' death. That could include lost earnings and lost future earnings. It could include medical expenses, funeral expenses and more.

For example, if someone was earning $1 million a year and they were 55 years old, then we can calculate that this person would likely have lived for another 19 years according to life expectancy tables.

We can also estimate how long this person would have continued to work earning that amount of money. Those documented earnings can then be given to an expert known as an economist who can calculate what the value of money is in the future compared to what it is worth today.

WHAT ARE NON-ECONOMIC LOSSES?

The damages and losses the family suffers that are subjective and cannot be readily calculated are what is commonly referred to as “pain and suffering.”
