Imagine if hospitals advertised their errors.
It's inconceivable that a hospital would voluntarily tell the world about errors they committed.
While thinking about common defenses we typically see in medical malpractice cases here in New York, I couldn't help but think how amusing it would be if hospitals and doctors actually advertised their services and explained to potential patients the fact that they are human and fallible.
Interestingly, at trial, one of the strategies we can use is to admit something that might be harmful before the defense has had an opportunity to 'out us' and get first shot at telling the jury about it.
By us bringing it up first, it then minimizes the impact and we can make it out to be not that significant compared to if the defense were the ones to bring it out first.
Do you think a patient would still want to go to a hospital or a doctor who has admitted that they screwed up in the past?
It's an interesting concept and I was playing around with different ideas today and thinking how funny it would be if a doctor actually did this.
By the way...the likelihood of this happening is, in my opinion, absolutely zero.
