Can I Settle Case WITHOUT My Client's Consent?

Your case has been in litigation for some time now.
As we are approaching a trial date, the defense calls me and makes an offer to settle your case.
Can I tell the defense lawyer that we accept their offer if I believe is appropriate without ever speaking to my client?
Is it ever acceptable for me to settle a case without first talking to my client and getting his consent and approval?
The answer is absolutely NO.
There is no possible way I permitted to ever settle a case without my client's consent and authorization.
The appropriate response to the defense attorney is to thank him for his offer and to let him know that I must first speak to my client in order to discuss and evaluate his offer.
Once my client has made an educated decision, I will be happy to get back to him and let him know his answer.
Then, I can contact my client and have a detailed discussion about the pros and cons and risks and benefits of accepting or rejecting the defense's offer.
We can formulate a strategy of whether or not to accept this offer and whether to make a counteroffer.
Only then, can you make an informed decision about what is appropriate for you and your particular case.
Even though I speak for you, you have the ultimate decision in whether or not to accept a settlement offer.
There have been instances were I will make a recommendation to accept a settlement offer and my client refuses.
On the other hand, there are instances where I recommend not accepting the defense's settlement offer and you decide not to take my best legal advice and instead accept their offer.
