3 Questions Jury Must Answer In YOUR Favor to Win Your Civil Case in New York

You sued your doctor.
For medical malpractice.
You claim he caused you significant harm and injury.

Your doctor disagrees.

He claims he did nothing wrong.
He claims you caused your own injury.
Besides, he claims your injuries are not really that bad.

That means your doctor does not admit any responsibility.
That means there's an issue about who is responsible for causing you harm.
That also means there's an issue about what your injuries are really worth.

That means you will proceed forward with litigation.
In New York, that could take 2-3 years.
From the time you start your case until trial.

The defense hotly contests every claim you are making.
That means a jury will have to decide whether you are more likely right than wrong.
That means a jury will decide whether you are entitled to a verdict in your favor.

But how exactly does the jury reach a “verdict”?
Do they simply tell the judge that you are entitled to win?
The answer is no.

Instead, the jury is given a series of questions they must answer.

The jury must answer each of these questions in your favor in order to receive a favorable verdict.

Want to know the first question?
It has to do with who is legally responsible.
The first question the jury must answer has to do with carelessness.

In law, we call that liability.
Was the person that you sued careless?
Legally, we ask it this way: “Was the defendant negligent?”
