FMCSA may Require Dispatch Services Obtain a Broker Bond - are Truck Dispatchers Freight Brokers?

The FMCSA is looking at potentially requiring dispatch services to obtain a broker bond. Who does this benefit? Is it good for truckers? Is it good for freight brokers?

The FMCSA is once again looking at the definition of what a freight broker is and whether or not dispatch services should be required to carry a broker bond or not. Ultimately the questions is, are dispatch services a broker or a bona fide agent? The answer they're working on may surprise you!

The qualifying metric looks at whether or not the truck dispatch services company is servicing a single motor carrier or multiple motor carriers.
They're looking at the idea of truck dispatchers participating in the arrangement of freight, allocation of traffic, the exchange of money, and other stipulations.

The question that should be on everyone's mind is whether finding a good load, negotiating the rate, and communicating the load details with the truck driver should be considered as participating in the arrangement of freight. What does allocation of traffic even mean? What exactly does it mean to exchange money?

TIA or the Transportation Intermediaries Association that backs brokers, says they want broker bonds to be a requirement for all dispatch services, truck dispatch services, and anyone who wouldn't be able to classify themselves as a bona fide agent. This is a tricky situation for the FMCSA, especially considering the slippery slope they're on with all of this.

What do we think about this considering we've been in business for so many years and started before it was popular to be a truck dispatcher. Our thoughts are with the TIA for once and here's our reasoning. Way too many truck dispatch companies have popped up over the years and too many of them provided a disservice to truckers all over the country. They practiced on truckers and only benefitted themselves during hot freight markets. Once the freight spot market cooled down, they wouldn't pick up their phones and left their customers sitting at truck stops on their own. That's no way to run a business.

We're all about equal opportunity and we want people to succeed but the lack of work ethic, the idea of easy money, and only working during the peaks in the spot market is not viable for truckers and it leaves a bad taste in their mouths. This ultimately leads to trucking companies labeling dispatch services as a money grab and word gets around quickly. We're always fighting an uphill battle and we want dispatch services for owner operators to be at the same level as the professional truck drivers. Truckers already have it tough and shouldn't be taken advantage of.
