Can Defense WITHDRAW Their Settlement Offer?

You sued your doctor for medical malpractice.
Your doctor ridicules your lawsuit.
He tells you he'll never settle.

Two years later, as your case gets close to trial, your lawyer tells you that the defense now wants to negotiate. In fact, they make you a settlement offer.

You reject it.
The defense tells your lawyer it's a fair offer and minimizes the risk for both sides. The defense minimizes their risk by limiting the amount they have to pay out. Your lawyer minimizes the risk by getting you a substantial amount of guaranteed money without the risk of going to a jury verdict and not knowing what the jury will do.

You still reject it.
The defense tells your lawyer that if you don't accept their offer within 48 hours, the offer is withdrawn and they'll see you at trial.
Can the defense do that?

The answer is yes, they can.
It doesn't happen often, but in some cases it is done.
The defense might suggest that You're being unreasonable and as a way to put lots of pressure on you, they may give your attorney a time limit to accept their offer or withdraw the offer.
