I was questioning a doctor.
In a medical malpractice case.
My client sued two doctors.
We claimed that both doctors were careless and caused him harm and injury.

During the lawsuit, I had an opportunity to question each of the doctors whom my client sued.
I'll call them Doctor #1 and Doctor #2.
When I questioned Doctor #1 during his pretrial deposition, I asked him many questions about what he did and why.
I asked him questions about his knowledge of Doctor #2 and what Doctor #2 did and whether he communicated that information to Doctor #1.

During my questioning of Doctor #1, his attorney yelled out "OBJECTION! DON'T ANSWER THAT QUESTION DOCTOR, ON THE GROUNDS OF CARVALHO!"

What does that mean?
The defense attorney argues that I can't ask opinion questions about what Doctor 2 did and whether Doctor #2's treatment of my client departed from the standard of care causing my client harm and injury.

There is a case in New York called Carvalho.
It basically says that I can't use Doctor #1 as an expert to point a finger at Doctor #2.
However, I can't ask Doctor #1 opinion questions about Doctor #2, especially if they were working as a team caring for the patient.
