You should know that in New York, a medical malpractice or wrongful death case typically takes anywhere from 2-3 years from start to finish.

Many injured victims don't want to spend that length of time litigating their case.

On the other hand, many injured victims have nothing to lose and they've already lost a significant part of their life because of someone else's carelessness.

The reality is that settlement negotiations can occur at any time.
They can be started by any of the litigants, their principals or the attorneys.

They can occur during the claim process before a lawsuit is started.
They can occur immediately after the lawsuit is started.
They can occur during the discovery phase of your lawsuit.

Once your case is on the trial calendar, settlement negotiations can occur from that point up until jury selection.

Settlement discussions can begin even in jury selection.
They can occur after opening arguments at trial.

Settlement negotiations can begin while witnesses are on the witness stand and being cross examined.

Settlement negotiations can occur even while the jury is out deliberating.

Believe it or not, settlement negotiations can even occur AFTER a jury has returned a verdict in favor of the injured victim.
