Three San Diego Police Department officers—Gregory Bergman, Michael Thornton and Jonathan Estrada—were found not criminally liable in the 2022 City Heights fatal shooting of John Ray Romero, 58, who was holding an airsoft gun. A California Department of Justice investigation concluded there was insufficient evidence to prosecute the officers, while noting Romero initially pointed the gun at his head after riding a bicycle to an apartment complex. The DOJ said officers reasonably believed Romero intended to harm officers or bystanders when they opened fire after multiple commands to drop the weapon, and Romero lifted the gun as he peered over a car hood, prompting a second volley. The airsoft gun lacked markings indicating it wasn’t real. The report recommended SDPD improvements in de-escalation and use-of-force policies, including single officers communicating with suicidal subjects, scenario-based training for armed suspects in mental health crises, PERT integration, and aligning policies with state law.
