What Would Prompt Defense Attorney to Begin Negotiating With You in Your Medical Malpractice Case?

What would prompt the defense lawyer to want to start negotiations on your case?

There are a few reasons that might cause them to start negotiating...
(1) You're able to show that your doctor was careless.
(2) You're able to show that your doctors' negligence was a cause of your injury.
(3) You're able to show that your injuries are significant and/or permanent.

Any one of those three things might just prompt your opponent to want to start talking about trying to settle your case.

If you have two of those things, that may give them a greater incentive to want to settle. If you have all three of those things, backed up by a well-qualified medical expert, that may give the defense a greater incentive to want to try and settle your case.

Keep in mind that just because settlement discussions take place, does NOT mean you will settle your case. It's simply the possibility. Whether both sides can reach a mutual agreement is a topic for another video.
