Do I Have to Remain in Chapter 13 if I Surrender my Home?

Most people file Chapter 13 for a very specific purpose. Often the driving force behind a repayment plan type of bankruptcy involves stopping a foreclosure and catching back up on mortgage payments.

Sometimes, however, the monthly payments involved in a Chapter 13 plan are too much. If this happens to you then you and your lawyer may decide that it is best to amend your Chapter 13 plan to surrender your house.

If you surrender your house, however, your Chapter 13 plan does not go away - you remain in bankruptcy. Does this make sense? Do you have any options either inside or outside of bankruptcy?
