Should You File Bankruptcy Immediately When Expecting a Lawsuit?

You may feel very stressed if you make a decision or take an action that will likely result in adverse legal action. Perhaps you turned in a car that you could not afford, broke a lease or simply stopped paying a debt.

Should you file bankruptcy proactively to avoid collection calls and eventually legal action?

As I discuss in this video, I usually advise my clients to hold off on filing bankruptcy until there is certainty that a creditor will be pursuing you. Many times, creditors or collection agencies make the decision that not enough money is involved to justify the cost of legal action. In other cases, your file is one of thousands that someone may or may not flag for litigation.

Another reason to delay filing bankruptcy involves your need to engage in pre-bankruptcy planning. For example when I meet with prospective clients, I ask about recent purchases, sales, gifts, changes in income, credit card use and many other matters. Even if bankruptcy would solve one problem, the timing may not be right given other things happening in your life.
