In the state of California, domestic battery is when someone purposefully inflicts unlawful physical force on either an intimate partner (such as a boyfriend or girlfriend), a spouse, or a domestic partner. The intimate partner or spouse can be current or former, such as an ex-husband or an ex-girlfriend.
The penalties for someone convicted of domestic battery depend on the type of physical force used, and the extent of the injuries. Simply slapping someone, while still a serious crime and considered domestic battery, is punished less harshly than an attempted strangulation, that leaves bruising on the victim's neck (ligature marks).
