When a murder occurs in the United States, most of the time it falls under the jurisdiction of the local laws of the state or territory in which that crime occurred. However there are several circumstances in which murders violate federal law or take place on federal land. Under these scenarios, the crime can be prosecuted as a federal murder. Federal murder trials take place in federal courts, and are overseen by federal judges.

Examples of murders that violate federal law are: murders of a federal judge or federal law enforcement agent (such as FBI, CIA, TSA, or ATF), or their immediate family members, murders of a politician such as an elected or appointed federal official, murders committed during a bank robbery, or murders that were intended to influence a federal trial.

In addition, any murder that happens on federal land, or in a place under United States of America jurisdiction, but with no local jurisdiction, can also be prosecuted as a federal murder. Examples of federal land are National Parks, Bureau of Land Management (BLM), Native American reservations under the Bureau of Indian Affairs, Department of Defense, National Forest Service, National Fish and Wildlife Service, and any time a murder takes place on an boat, vessel, or ship at sea, such a as a cargo vessel engaged in interstate commerce.
