In a dramatic courtroom appearance in California, Elon Musk testified against OpenAI — the AI company he co-founded in 2015 alongside Sam Altman. On the witness stand, Musk called himself a "fool," saying he essentially provided free funding that helped build one of the most valuable tech companies in the world. He claims that assurances given by CEO Sam Altman about OpenAI's nonprofit mission were broken when the company established a for-profit subsidiary in 2019 — a year after Musk left its board.

"It's not OK to steal a charity," Musk told the court.

However, OpenAI's legal team pushed back hard. Attorneys presented emails allegedly showing Musk himself urged the company to pursue a for-profit model while still a board member, reportedly arguing OpenAI needed "billions per year immediately" to compete with Google. When asked whether he fulfilled his original pledge of $1 billion, Musk responded: "I contributed my reputation."

OpenAI also alleged that Musk launched his own AI company, xAI, after the company refused to hand him unilateral control — a claim that adds a competitive dimension to the legal battle.

Musk is now seeking over $180 billion in damages. He is also asking the court to remove Altman and OpenAI President Greg Brockman from their positions and reverse the company's for-profit conversion.

In October, OpenAI completed a restructuring that transformed its nonprofit into a foundation holding a $130 billion equity stake in a new public benefit corporation — a move Musk's lawsuit directly challenges.

This trial has major implications for the future of AI governance, nonprofit accountability, and who gets to control some of the most powerful technology ever built.
