Professor Adam Tomkins on the Legal Implications of Scottish Independence

Adam Tomkins, Professor of Public Law at the University of Glasgow, states in quite clear terms that if Scotland separates from the UK it becomes as a matter of law a new state. This means it would have voluntarily chosen to leave the UK's institutions - of which include the pound. Tomkins indicates that Scotland has no automatic right to retain any of the UK's institutions and it should not expect to. Anything and everything must thereafter be negotiated, and because of the complications around such matters the SNP's 18 month timetable of separating from the UK is wholly unrealistic.

Then the nationalist tells him he is wrong and Westminster are lying. Who do we think is more qualified to speak on these matters? Who do you believe?
