How do I know if I have been a victim of medical malpractice?
Hi there. I’m medical malpractice John McKiggan. I get calls all the time from people wondering if they have been a victim of medical malpractice.
So what is Medical Malpractice?
Medical malpractice happens when the treatment provided by a health care provider (like your doctor, nurse, hospital, dentist etc.) falls below the accepted standard of care.
Health care providers are human and they are not expected to be perfect. Sometimes medical treatment is not successful but that does not necessarily mean the doctor was negligent. Negligent treatment (medical malpractice) is treatment that falls below the generally accepted standard of reasonably competent care.
Medical malpractice may involve the following:
• Failing to properly diagnose a medical condition;
• Failing to provide appropriate medical treatment;
• Failing to refer the patient to the proper medical specialist;
• Failing to perform surgery with reasonable care;
• Failing to provide proper post-operative care.
But even if you are able to prove that your doctor made a mistake, in other words, the doctor was negligent, you may not win your malpractice claim. Why is that?
In addition to proving that your health care provider was negligent, you must also be able to prove that the negligence caused your injury.
For example everyone knows that doctors are supposed to wear latex gloves when they do surgery. If your doctor doesn’t wear latex gloves, that is a breach of the standard of care and is evidence that the doctor was negligent.
But what if the injury you are complaining of is chronic pain at your surgery site? Failing to wear surgical gloves probably didn’t cause your pain.
On the other hand, if you develop an infection at the surgery site you may be able to prove that the Doctor’s negligence caused your injury because surgical gloves are specifically intended to prevent infection.
