Hi there. I’m Nova Scotia personal injury lawyer Mark Raftus and today I want to explain how the courts will calculate the compensation you are entitled to receive for your personal injury claim.

The goal in any personal injury claim is to put the injured person (or their surviving family members) in the same position that they would have been in if the injury or death didn’t happen.

There are several categories of harms or losses that the courts will compensate you for if you have been injured. Some examples are:

• Non-Pecuniary Losses - A "non-pecuniary" loss is one that does not result in a direct out of pocket financial loss, but is still considered to be of value. Non pecuniary losses are sometimes referred to as compensation for “pain and suffering” but they cover any other type of non-financial loss, like loss of companionship of a loved one in a fatal accident claim.

• Pecuniary Losses - A pecuniary claim is one that has (or will) result in a direct out of pocket financial loss. For example, the cost paying for medical treatment is a pecuniary loss. Past and future income loss is also a pecuniary loss. The cost of repairing your car or bicycle is a pecuniary loss.

• Special damages - These are out of pocket expenses that you incur before trial. Things like the cost of getting medical records or reports.
