Four Employment Partners Explain the Business Impact of the CDC’s New Face Mask Guidance

On May 13, 2021, the Centers for Disease Control and Prevention surprised us all when it announced that fully vaccinated people no longer need to wear a mask or physically distance in any setting.

Don’t throw out those masks yet—there’s a catch. Everyone must continue to wear face masks where required by federal, state, local, tribal, or territorial laws, rules, and regulations, including local business and workplace guidance. Now, many businesses are asking questions like:

- Should we allow fully vaccinated people to go maskless at work?
- How do we create and enforce work rules that allow some to go maskless?
- Can we demand proof of vaccination? Or are there confidentiality considerations?
- How can we accommodate employees with anxiety (and other mental health issues) about unmasked coworkers?
- What are the risks of having different rules for different groups?
