Wage theft is the number one problem in Florida. Wage theft happens when employers refuse to pay tips, minimum wage, or overtime wages that the employee is due. There are a couple of legal options available to you after you are a victim of wage theft. One, you can make a complaint to the federal government. Two, you can speak professional guidance from an employment attorney. Today we are going to talk about these two options for dealing with wage theft.

First, filing a complaint with the department of labor. They will investigate your case to see if you were subject to wage theft. However, most often they will only launch a full investigation if they believe that a large number of employees have been affected by one employer. Unfortunately, it has been found since the pandemic that the DOL has been failing to adequately deal with wage theft cases.

Secondly, private enforcement. You can elect to hire a private employment attorney to help enforce the law. Employes usually receive twice their back pay as a remedy for a violation. Also, it is illegal for an employer to retaliate against an employee for hiring an attorney to look into unpaid wages. In the end, it is hardly beneficial to submit a complaint to the federal government.
