Domestic Violence convictions: Losing gun rights in California

A domestic violence conviction can cost you your gun rights in California, as this former Los Angeles prosecutor explains.

A felony conviction for any crime triggers a lifetime prohibition on using, owning or possessing a firearm in California. But there is also a list of misdemeanor crimes, a conviction for which imposes a 10-year ban on gun rights. This list includes most domestic violence crimes, including corporal injury to a spouse (Penal Code 273.5). domestic battery (Penal Code 243e1). stalking (Penal Code 647.6), criminal threats (Penal Code 422), simple battery (Penal Code 422) and assault (Penal Code 245).

Normally a reduction of a felony to a misdemeanor (Penal Code 17b) will restore a person's gun rights. But if the misdemeanor version of the crime is on this list, he or she must wait an additional 10 years before enjoying restoration of gun rights.
