Patna HC Quashes Prosecution Against Orthopaedic Surgeon Over Lack of Expert Evidence

The Patna High Court has ruled that criminal prosecution for alleged medical negligence cannot continue against a doctor unless there is prima facie evidence of gross negligence supported by a competent medical opinion. The Court made the observation while quashing criminal proceedings against a doctor accused in a 2012 case involving the death of a patient after surgery. It stressed that medical negligence giving rise to civil liability is different from criminal culpability and warned that unnecessary criminal prosecution could discourage independent medical decision-making.
