New legislation targets judges who release 'dangerous repeat offenders' in wake of CATS stabbing
Rep. Tim Moore introduced legislation Wednesday that would allow crime victims to sue judges over bail and sentencing decisions, eliminating longstanding legal protections for the judiciary.
The Judicial Accountability for Public Safety Act of 2025 would create a path for victims or their families to file civil lawsuits against federal, state and local judges who make bond or sentencing decisions with "gross negligence" or "intentional disregard for public safety."
Under current law, judges are shielded from civil liability for decisions made from the bench. Moore's bill would strip that immunity in cases where plaintiffs can prove by "clear and convincing evidence" that a judge's decision directly led to their injury.
"When judges let dangerous repeat offenders walk free despite knowing the risks, and someone gets hurt or killed, there has to be accountability," Moore said. "We've seen too many cases, like the killings of Iryna Zarutska and Logan Federico, that were completely preventable if their murderers were behind bars where they belonged."
Moore specifically criticized what he called "judicial systems in Democrat-run cities that favor criminals over victims," saying they are "failing innocent Americans."
