My son was charged with a DUI but he's only 17 what impact will have this have on his case when you're under 21 we call those baby du because it it treats you differently the punishments are a little bit better in the sense that you don't have to go to jail like you do for other DUIs the law specifically States if you're over 21 and you're convicted of a DUI you have to go to jail it and then it depends what your blood alcohol concentration is when you're under 21 there's no requirement that you have to go to jail but there are other implications or Consequences associated with that that are almost worse than if you were 21 for example you're going to lose your license for two years the biggest difference I would say when you're under 21 is you're no longer bound to that 08 being the legal limit since you're under 21 can't drink period so you don't even have to be impaired or or drunk to get that DUI
