Penal Code 148.4 PC makes it illegal to tamper with or break a fire alarm, pull a fire alarm when there hasn't been a fire, or call and make a false report of a fire.
If convicted of 148.4 PC, it is a misdemeanor offense, and the guilty party can face fines and up to one year.
However it is very common for innocent people to be charged with this offense. Often times this crime happens at crowded parties, or when people have been drinking. There may be confusion about who exactly pulled the fire alarm, and oftentimes the wrong person gets blamed. Or perhaps the fire alarm was pulled accidentally. To be convicted of 148.4 PC the act must have been intentional. Or perhaps you really did think there was a fire or some other kind of emergency that merited the alarm being pulled. If you did not have malicious intent when you pulled the fire alarm, then you have not committed the crime of 148.4 PC.
If you or a loved one is charged with a crime we invite you to contact us at Shouse Law Group. We can provide a free consultation in office or by phone.
