Zarzaur Law, P.A. TV: Client Case Study - Severe Neck Injury After Car Wreck (Part I)

Attorney Joe Zarzaur and Dr. Evan Malone begin this three-part series of walking through a client case – from a car accident, ER visit, diagnosis, surgery, and how important it is to have the right lawyer to ensure that you are made whole. What seemed like a very simple “whiplash” injury in a car wreck (according to the ER) ended up being a herniated disc that required surgery and a lot of unforeseen medical expenses.

We're going to use actual documents from a couple of different cases so that it brings authenticity to what we're talking about. And it will allow you as the person may be consuming this information to actually see the same documents that you would see in your case.

THE FIRST WEEK TO A MONTH

THE ER VISIT IS ONLY TO MAKE SURE YOU ARE NOT GOING TO DIE OR LOSE A LIMB
Weeks to a month of a car wreck case involves intake at an ER. The emergency room is not there to diagnose your injury, they are they're ruled out and you're going to die in 24 to 48 hours or lose a limb or some sense.

The diagnosis you're going to get in the ER is the “contusion low back pain muscle spasms of the head and neck from a motor vehicle accident.” The ER thought is not going to have the benefit most of the time or the pictures from the accident scene of how the accident happened.

QUESTIONS IN THE ER INCLUDE
1. Did your airbags deploy?
2. Did you strike a hard object? (like the steering wheel windshield.
3. Were you restrained?
4. Where were you in the car?

THE WRECK REPORT & DRIVERS EXCHANGE REPORT
The wreck report that you will not immediately get at the scene (it will be available 24-48 hours later) will have a diagram. You will get a driver's exchange of information form. It will say who got the ticket and it will have a diagram, of the accident scene and the placement of the vehicles in the accident. Our client in this case was t-boned.

THE ER RELEASED THE CLIENT, THEY HAD DISCHARGE INSTRUCTIONS BUT WAS STILL IN PAIN
Most clients that call say - I went to the ER, I don't think I really need a lawyer, but the wreck was pretty severe, the airbags went off, it totaled my car, and I feel bad.

So, you get a piece of paper that looks like this (discharge instructions), and then this one for back pain, which is neck pain, right. They call it cervical sprain or “whiplash” sometimes too. So, you're going to have these discharge instructions. You should follow these. But you're going to get the impression well, they were discharged by a hospital doctor, so it must not be a serious injury.

NEXT STEPS: THE ATTORNEY, TREATING DOCTOR, AND THE MRI
So, the next steps in the process usually are - the client will call us and that's typically where I'm talking to them. They've left the ER; they feel like they're not going to be critical. The ER doctor has made them feel better about the situation because they got released.

We find a doctor that will treat the client after a car wreck and then ultimately, they're going to put you in an MRI machine while you're going through the treatment process to determine if there is injury and damage to the soft tissue.
