What is the effect of the new Expungement Law?
There’s a new version of the Expungement Law in South Carolina which opened up a couple of things to be eligible for expungement.
For example, before possession of drugs, other than marijuana, could not be expunged. Now, if a person hasn’t been convicted for anything in twenty years – in other words, the offense happened when someone was young, and now they’re an adult – under certain circumstances even a possession with intent to distribute, which is considered felony weight on different drugs, the person can, under certain circumstances, get an expungement.
The other things is that it expanded the Youthful Offender type of expungement to include offenses where someone pled guilty, they were under the age of 25 at the time of the conviction, and now five years have passed since the probation ended. That's new and those are things that are beneficial; it’s very important for people to be able to get expungement under certain circumstances.
So, the law continues to evolve a little bit and it’s a good thing to see because those convictions follow people around, they hurt their life, they hurt their ability to earn money, it hurts them in background checks, and do, it’s good to see that the expungements process is being opened up a little bit more.
