A: The fine is the greater of $5,000, or 75% of the income related to that tax
return. The assessed penalty can target a substantial part of the return preparer’s income. Keep in mind that IRS will assess the penalty for multiple tax returns
at a time. Each violation gets a separate penalty.
A tax attorney can discuss the defenses allowed under section 6694.
But, only a tax attorney that handles both civil and criminal tax matters should address any violation involving willful acts.
