Reasons for denial of disability benefits in Missouri #5 onset date
Hello. This is Springfield disability attorney Jason Krebs with the next in our series, why people are denied at the application level and things that they can do to avoid these problems in Southwest Missouri and Northwest Arkansas.
Today I want to talk about onset date. The onset date is the date that you believe that you became disabled from being able to work. It's a very important date because for a couple of reasons. One, that's when your back award may go back to. There is a 5 month wait before they would pay you. People sometimes get a little greedy and try to push their onset date back sometimes even years. This is where claimants are claiming their onset date was 10 years ago and they worked until a year or 2 ago. You've just made Social Security's job very easy to deny you because if you were working and making more than the minimum, which right now in 2015 is $1090 a month. That's going to go up a little bit in 2016 to a little over $1000 a month. If you were working in doing that by definition you're not disabled. You've made their job easy to deny you at that point.
You have to kind of be judicious and be conservative in the date that you say you became disabled. Usually that's the date maybe you work, if you've got a good solid work history and you just couldn't work anymore and that's the day that you quit, that may be supportable. Maybe it's the date of the accident, or maybe it's the date of a particular medical test that shows that. There's a lot of different factors involved in that but if you try to go back years ago you're probably going to get denied just automatically, especially if you were working.
Always be very aware of "how am I going to support that date that I'm saying I became disabled?" It needs to have some relevant evidence as to why that's the time that you became disabled. When in doubt, don't go as far back as you might want to, even though you might want the money or need the money. If you go way back you're going to probably find it pretty hard to support that date and you're going to be denied automatically.
