Hello. This is Springfield, Missouri disability attorney, Jason Krebs. And today's video is part of our series, things that can ruin your Missouri or Arkansas disability claim. The thing that we're going to talk about is failing to appeal.
Now, in Missouri, Missouri's one of a handful of states that does not have the reconsideration level. You have 60 days to file an appeal. If you don't, you have to start the process all over again.
Now, in Arkansas, you have 60 days to file a reconsideration. A reconsideration is another examiner is going to look at, effectively, the same evidence. You're entitled to add more but pretty much the same evidence. And then if you're denied there, then you have 60 days to file your appeal there, and that goes for people in Arkansas, Oklahoma, or Kansas.
One of the things that we see is people, they get frustrated, they don't appeal, or they just keep reapplying, reapplying, reapplying and never take it to the hearing level. That's a big mistake because if you keep doing that wrong enough and you haven't been working, you're going to run yourself out of time to get full disability benefits. You'll be no longer insured, and that's what we talked about in one of our other videos. So it's important to get hold of somebody, take action, don't just set it aside. You're not, it doesn't benefit you to wait 60 days because if you have a year plus wait for a hearing, that's just another two months that you're setting yourself back there, so you want to take action, contact an attorney that handles a lot of disability cases, and take action. Documentation is still going to be key. You need to use that time to your advantage, but just setting it aside and not do anything for six months, you're going to have to start the process over, and ultimately, you may lose a lot of benefits, you may lose money there.
