Suborn means to intentionally convince, bribe, or procure another person to commit a legal wrong. In modern legal frameworks, it is almost exclusively tied to the act of lying under oath.

Suborn, legally formalized as subornation of perjury, is the criminal offense of deliberately inducing or persuading a witness to give false testimony during a judicial proceeding.

Why is subornation treated as such a severe crime? It undermines the foundational integrity of the entire justice system. Across the US, UK, Australia, and Europe, courts rely on truthful testimony to uncover the reality of a dispute. To secure a conviction for subornation, prosecutors must prove two specific elements. First, that the witness actually committed perjury by lying under oath. Second, that the defendant knowingly and intentionally forced or persuaded them to do so. It is a felony that carries heavy prison sentences.

For example, a wealthy executive is on trial for corporate fraud. Knowing the evidence is strong, the executive offers their personal assistant a fifty thousand dollar cash bribe to lie on the witness stand about who authorized the transactions. The assistant takes the money and lies under oath. If discovered, the executive will be charged with suborning perjury, facing severe criminal penalties separate from the fraud itself.
