Ejectment is a common law civil action brought to recover the possession of real property. Depending on the jurisdiction, it is also known as a possession action in the United Kingdom, or an eviction proceeding in the United States and Australia.
This legal remedy is utilized when someone is occupying land or a building without the lawful right to do so. The primary goal of this lawsuit is to physically remove the unauthorized occupant and restore full control to the rightful owner. Historically, it was a highly complex proceeding used to establish a person's underlying title to land. Today, it is more commonly used as a straightforward procedural tool for property disputes. A successful lawsuit typically results in a court order directing law enforcement to remove the trespasser. It may also allow the rightful owner to collect financial damages for the time they were wrongfully deprived of their property.
For example, imagine you own a rural cabin that you only visit during the summer months. Upon arriving one July, you discover that a stranger has broken the lock and has been living inside for several weeks. The stranger refuses to leave, claiming they have nowhere else to go. You cannot simply force them out yourself using physical violence. Instead, you must file an ejectment action in the local court. A judge will review your property deed, confirm your ownership, and issue an official order directing the county sheriff to remove the squatter.
