In the case of State of Wisconsin vs. Fizan Kabir (Case No. 215-8240), a probation hearing was held to address Mr. Kabir’s repeated bond violations. Mr. Kabir was originally charged with DWI and ordered under strict bond conditions, including no alcohol or drug use, installation of an interlock device, and use of a SCRAM device to monitor alcohol consumption.
The court reviewed three separate bond violation reports:
September 23, 2024 – Mr. Kabir’s interlock device was in lockout, possibly due to unpaid fees.
January 6, 2025 – Another lockout occurred due to failure to recalibrate the interlock device.
February 4, 2025 – Most critically, the SCRAM device detected alcohol consumption on January 16, 2025, at 11:55 PM, which was confirmed by a SCRAM analyst.
Despite prior warnings and leniency from the court, Mr. Kabir continued to violate the terms of his release. Defense counsel argued that the first two violations did not indicate actual alcohol consumption and attempted to discredit the SCRAM report as unverified. However, the court emphasized that bond is granted based on the defendant's compliance and public safety, both of which Mr. Kabir failed to uphold.
Ultimately, due to the repeated and confirmed violation of bond conditions, Judge Mogen revoked Mr. Kabir’s bond and ordered him into custody, stating, “It would be unreasonable for me not to.”
