DEED OF SALE "LUPA BAHAY" for beginners Philippines, PROCESS, REQUIREMENTS, BIR, REGISTRY OF DEEDS,

BIR Requirements:

STEP 1 (Go to BIR Officer of the Day ONNET)
Mandatory Requirements:

• Notarized Deed of Absolute Sale

• Acknowledgement Receipt

• Photocopies Valid Government IDs of Seller & Buyer with 3 Signatures

• TIN of Seller/s and Buyer/s (Use BIR Form 1904) (see 1 & 2)

• Certified True Copy of the Tax Declaration from Assessors Office -House and Lot
(see 3)

• If no Building/Structure get “Certificate of No Improvements from Assessors Office- (see 4)
• Certified True Copy of Original (OCT)/ Transfer (TCT)/ Condominium Certificate/s of Title (CCT) – Registry of Deeds

 Special Power of Attorney (SPA), if the person transacting/processing the transfer is not a party to the transaction

 Secretary’s Certificate or Board Resolution, approving the sale/transfer of the real property and indicating the name and position of the authorized signatory to the Deed of Sale/Assignment, if the seller/transferor is a corporation.
 Certification from the Philippine Consulate (if executed abroad);
 Location Plan/Vicinity map if zonal value cannot be readily determined from the documents submitted; (One (1) original copy and two (2) photocopies)

• Payments:
 Ask “Officer of the Day” at Onnet Section for Computation of “CGT 6% & DST 1.5%”
 For CGT - Fill-up BIR Form 1706 & Pay (see 5)
 For DST – Fill up BIR Form 2000-OT & Pay (see 6)
 Pay Certification Fee 100 + P15 Docs Stamp

STEP 2

• Provide 2 Photocopies of all Documents mentioned in Step 1
• Submit Documents in Step 1 together with Computation Sheet
• Get “Claim Stab”
NOTE:
REPUBLIC ACT No. 11032 (Ease of Doing Business)
Section 9 - All applications or requests submitted shall be acted upon by the assigned officer or employee within the prescribed processing time stated in the Citizen’s Charter which shall not be longer than three (3) working days in the case of simple transactions and seven (7) working days in the case of complex transactions from the date the request and/or complete application or request was received.

Step 3-Pay the Transfer Taxes at the Local Treasurer’s Office more or less .75% of based on Sale
Step 4-At the Local Treasurer’s Office also secure the Tax Clearance by presenting the following documents
• Photocopy of ECAR (see 7)
• Original and one Photocopy of the Deed of Absolute Sale
• Photocopy of the Tax Declaration
• Official Receipt of Payment of Real Property Tax and Special Education Fund Tax for the Current Year
STEP 3 (Registry of Deeds)
1. Original copy of the Deed of Absolute Sale (Notarized and duly stamped by BIR)
2. BIR ECAR for capital gains tax
3. Original Owner’s Duplicate of Title
4. Transfer Tax Receipt (from City Treasurer’s Office)
5. Realty Tax Clearance (From the City Treasurer’s Office)
6. Certified copy of Tax Declaration (From the Assessor’s Office)
7. Original Official Receipts Payments of CGT, DST, Tax Clearance Certificate and Transfer Fee
8. If any of the parties is a corporation, Secretary Certificate
9. If Property is agricultural, DAR clearance
10. SPA if any.
11. Pay Registration Fee (more or less .50% of Deed of Sale)

Processing time 20 working days
STEP 4 (Assessor’s Office)
Once the title has been transferred to your name secure the new Tax Declaration at the Municipal or Provincial Assessor’s Office. Bring the following documents:
• Deed of Absolute Sale-1 photocopy
• TCT OR CCT-1 photocopy
• CAR-1 photocopy
• Transfer Tax Receipt- 1 photocopy
• Latest Tax Receipt OR Tax Clearance- 1 photocopy
• Conditional Requirement- some local assessors may require additional documents such as the Subdivision Plan,if the lot is subdivided, full-color photos of the house,lot,or condominium unit.
