A pretextual stop is the use of an alleged traffic stop to investigate the occupants based on their appearance. The Court said in Whren so long as the officer claims a violation of motor vehicle rules, it’s legal under the Fourth Amendment.
Whren is at the heart of “driving while black.” Drivers are stopped because of their race. Instead of treating the alleged traffic stop as a way to enforce traffic laws the officer will open the door and grab your wrists like you see in this video. But in theory, police ask to search. The request is just that: a question the driver is free to say yes or no. However, in reality, saying no to a police officer is an invitation for hostility, false arrest and violence...anything you can imagine and many things you wouldn't believe.
Legally(according to the law breakers themselves and treasonous SCOTUS), an officer may respond to a refusal with more questions about why the search was denied, or even intimidate or lie to the driver in order to convince them that consent is the best way to proceed. If an officer can manipulate or otherwise convince a person into consenting to a search, or simply say so in their reports, courts say the Fourth Amendment is not violated. Because of course once they find contraband, it was in plain site, or you volunteered consent. In the 99% of searches where they find nothing, they simply drive away and leave you with a vehicle damaged not even knowing their name if you are brave enough to complain. Back to the 1% where they find or plant contraband. Have you ever heard of a cop admitting we pulled you over because we felt like it? In person yes. In court, never.
Police are expected to lie about PC(probable cause) if it doesn't fall into their lap. Prosecutors script PC for the few police not smart enough to get it right.
Regardless, officers illegally search the car and threaten the driver for exercising constitutional rights. Under such real world pressures when dealing with police, consent might be a self‐​preservation strategy rather than a choice freely given.

So, our driver gives consent according to police despite his or her obvious refusal. The officer and backup rummage through the car and the personal effects inside. The driver sits by helplessly with handcuffs applied too tight causing nerve damage. As perfect strangers with guns look for a reason to throw him in a cage. And many times, they make it up. Probably because...
These searches come up empty. Just like the pedestrian stops in New York City under the “Stop‐​and‐​Frisk” program. A majority of these stops by police are innocent minorities. People who have committed no crime are pressured into searches. Drivers’ lives are interrupted, their cars invaded, impounded and/or ripped apart. And folks that pass by think nothing of paying police salaries to destroy the property and lives of their neighbors.

Overly aggressive policing tactics damage the relationship between law enforcement and the community. But that is a bonus for many of these officers. Treating segments of the public like criminals makes those neighborhoods and communities less safe because a police force that is resented will not get the cooperation it needs to be effective. And of course ineffective policing creates more demand for those very police that have proven themselves to be useless or worse.

The Supreme Court ruled that pretextual stops are constitutional. Not to mention slavery. They have been wrong on just about anything you can imagine as long as they can profit from it. Police departments across the country are not struggling with establishing their legitimacy. That is naïve. Policies that needlessly antagonize the people will never be reexamined as long as it is a way for police to profit and justify their existence. Prove me wrong.
