Administrator (Executor) Fees and Attorney's Fees - Shadi Shaffer; Esq.

http://www.assetprotectioncenter.com - In this video Attorney Shadi Shaffer explains the different types of fees charged upon settlement and close of a probate case. Both the Administrator (generally the family member of the loved one who has passed) and the Probate Attorney hired to assist in the administration of the probate case are allowed under the Probate Code to be paid for their time and services. This fee is determined and set under the laws of the Probate Code set by the State of California. These fees are based on the total market value of the estate (appraised by the Referee) not including the debts. Currently under the Probate Code the fees are determined as follows: 4% of the first $100,000 in the estate; 3% of the next $100,000 in the estate; 2% of the next $800,000 in the estate; 1% of $800,000 + . As you can see the fees charged can be quite large and can be charged by both the Administrator and the Attorney (so X 2).
