U.S. Court of Appeals Upholds Maryland's Handgun Licensing Law

Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statutes that might otherwise be infringing. Non-profit, educational, or personal use tips the balance in favor of fair use.

A U.S. Court of Appeals has upheld Maryland's handgun licensing requirements, affirming their validity despite a 2022 U.S. Supreme Court decision that expanded gun rights. In a significant 14-2 vote, the Richmond-based 4th U.S. Circuit Court of Appeals overturned a prior 2-1 panel decision, which had deemed the 2013 Maryland law unconstitutional. This law, part of the Firearm Safety Act of 2013, mandates that most residents seeking to purchase a handgun must obtain a license and complete training and background checks. The legislation was enacted following the tragic 2012 mass shooting at Sandy Hook Elementary School in Newtown, Connecticut, where 20 children and six adults lost their lives.
