In Ontario, if you die without a will, your estate is distributed under intestacy rules in a set family order—not to friends, an unmarried partner, or pets.

The law generally looks for a spouse and descendants first. If there’s no spouse but there are children or grandchildren, the estate goes to the descendants. If there’s no spouse and no descendants, parents typically inherit equally if alive. If the parents have passed away, siblings generally inherit, and in many cases a sibling’s children can inherit in their place. Nieces and nephews may inherit, but replacement inheritance usually doesn’t extend indefinitely to more remote relatives. If no eligible relatives exist, the estate may go to the government.

If you want assets to go to specific people or causes, making a will early is the safest step.
