Legitimation and Opportunity Interest
A common family law matter is an absentee Dad that shows up after several years and wants a relationship with their child. They will often file for legitimation, and they have rights to visitation but there are factors judges will take into consideration before granting the request. How long has it been since the father had an active interest in the child's life? Have they ever had an interest or provided support?
In this video from the Family Law firm Shewmaker & Lewis, Jimmy and Alexa Lewis discuss legitimation, opportunity interest, and the factors that go into the court's decision to grant legitimation.
