Survivor Annuities and Retirement Division

When dealing with retirement division and equitable division in divorces, it is often the case that small factors are left out of the agreements. One of those factors may be survivor annuities. Pensions will often have a survivor annuity that is similar to a life insurance policy on an asset like a pension. It can also be present in split pensions.

In the case of a split pension, if the worker passes away the pension stops unless there is a survivor annuity or survivor pension plan in place. In the case of a divorce, if the existing survivor annuity was not included in the original equitable division agreement from the divorce, the surviving former spouse will be out of luck.
