USCIS Request For Evidence - Why RFEs Are Issued And How To Prevent A Notice Of Intent To Deny

A USCIS Request For Evidence is not to be feared. Rather, a request for evidence, referred to as a USCIS RFE, provides clues for your green card success. (What if your I-130 petition for a spouse is denied? See Denied Marriage Petitions: How To Fight USCIS And Win: https://youtu.be/ZmRJEaZpejM.)

Here is an important distinction: A Notice Of Intent To Deny USCIS (NOID USCIS) is worse than an Request For Evidence. By responding to an RFE request for evidence, you can avoid having the government issue the next warning, that is, their intent to deny your petition or application.

The RFE letter from USCIS, whether it is a USCIS request for initial evidence or a USCIS request for additional evidence, will usually inform you what the government thinks is missing from the supporting documentation or application that you have filed. Clean up those issues, and the government is more likely to grant the immigration benefits you seek.

Usually, the government's misgivings fall into one of the following categories:

Missing And Omitted Basic Evidence (2:10)
Insufficient Proof You Meet Requirements (3:25)
Complex Legal Issues (7:35)

(Note: The numbers listed next to the topics are where, if you are strapped for time, you can jump ahead in the video to hear the discussion on that specific issue.)

By way of a request for evidence uscis can seek information from a broad range of immigrant benefits, including an I-130 RFE (a petition for a family relative), VAWA RFE (a petition for an abused immigrant spouse or child), I-485 RFE (an application for adjustment of status), as well as other types of immigration petitions and applications.

So do not fear a request for evidence. Embrace it. Respond to it as completely as possible. If you need assistance, reach out to a competent professional to assist. Do not allow an RFE to turn into a NOID.
