The Delhi High Court has ruled that if no candidate from a reserved category qualifies for a particular speciality, the National Board of Examinations in Medical Sciences (NBEMS) should obtain approval from the concerned State Government and de-reserve such seats before counselling, allowing them to be filled by eligible open category candidates instead of remaining vacant.
