A German court has said this summer that Tesla has been deemed to be misleading car buyers by using the word autopilot - and Tesla has been banned from using this misleading claim in Germany. Consumer reports reviewed self driving cars and found that other manufacturers like Cadalacs super cruise was safer because the car required you to look forward and not be distracted. And just 2 days ago another European auto group slammed Tesla saying Tesla’s autopilot fails at keeping the driver engaged because there’s little to verify you’re actually paying attention. As a Tesla owner, this is pretty true and a fair criticism. Honestly, I can just put a small weight on the steering wheel and trick the car into thinking I’ve holding the wheel and paying attention when I’m doing neither. Now I’m not condoning that, but lets just say Tesla’s self driving has been very powerful. But what about the camera? Right, let’s talk about that. Tesla said that this built-in cabinet camera is designed to automatically capture clips just before a collision or safety event. And this sounds reasonable - everyone wants safety. Well, a hacker named Green on Twitter, and thanks to Elektrek.co on for bringing this to my attention, just gave us insights into what Tesla’s model 3 might actually be able to track. The Tesla model 3 is able to track the following about your behavior:

EYES_CLOSED
EYES_DOWN
EYES_NOMINAL
EYES_UP
HEAD_DOWN
HEAD_TRUNC
LOOKING_LEFT
LOOKING_RIGHT
PHONE_USE
SUNGLASSES_EYES_LIKELY_NOMINAL

First it means Tesla is able to track how much its drivers actually pay attention to the road. But second it’s also able to establish whether or not people who pay attention to the road are safer than people who don’t pay attention to the road - AKA, is human intervention causing more accidents or is human intervention preventing accidents? This tracking technology is incredible - it’ll also track how many people use their phones on autopilot. Soon they’ll have to add an item for “using laptop while driving.” Well, it’s quite possible Tesla is future proofing here. See, here is a potential danger: if regulators suddenly force all of Tesla drivers to be attentive and Tesla is forced to make sure that drivers are attentive, then Tesla could see its autopilot shut down. However, by including a camera build into the rear view mirror and already collected data on whether people are paying attention, Tesla might be preemptively getting ahead of the game. Tesla could retrofit old Tesla’s with these cameras and push a software update to all cars that chimes or disables autopilot if you’re not paying attention. Now some say the lack of these driver attentive features is one of the reasons people love tesla. Either way, it’s also quite likely that Tesla wants this data to prepare for a future battle with regulators when this day comes.
