Including your partner on a student visa

The student visa allows for main applicants (those who are studying the course), to include their partner (spouse of de facto partner) as secondary applicants on the student visa. This will allow them to come to or remain in Australia throughout their studies.

To be able to have your partner join you on to study in Australia will mean you can stay together. Your de facto partner will usually have some form of work rights in Australia and it is also a lot more affordable to only pay for one person to study in Australia.

Meeting the De Facto Requirement
To be able to include your partner as a secondary applicant on your student visa, you must be classified as a member of the family unit of the main applicant. To be assessed as a member of the family unit you must be the spouse (husband or wife), or the de facto partner. This is not just the same for a student visa, but also most work visas to Australia.
By definition, to meet the de facto requirement you must prove that:

1. you and your partner are in a mutual commitment to a shared life to the exclusion of all others
2. are in a genuine and continuing relationship
3. live together and do not live separately on a permanent basis

Some of the requirements that immigration will judge your de facto relationship include:

• The Financial Aspect
• The Nature of the household
• The social aspect of the relationship
• The couples commitment to each other

By registering your relationship in a relevant state or territory you may be able to waive this 12 month requirement, but you will still need to demonstrate the other relationship components are met.

Work Rights:
If you are studying English a Vocational or a Bachelor level course, partners can generally only work 40 hours per fortnight. If your partner is studying a Masters or Doctorate, then you generally will be able to work full time.

Can I add my partner to my student visa after my student visa has been granted?
There are two common scenarios here. Firstly if when you lodge your initial visa application and you are in a de facto relationship, but your partner doesn’t want to be included initially/

If you meet the de facto relationship, but your partner does not want to come with you initially to Australia, you can list her as your non accompany de facto partner on your student visa application, however not include them on your visa application. This will make it easier for your de facto partner to later submit a subsequent visa application to join you in Australia.

The second scenario is if you do not list you de facto partner on my student visa (not even as an accompanying de facto family member)?
If you did not include your partner on your student visa application and you have since entered a de facto relationship since your visa was initial student visa was granted, you may be able to apply for a subsequent visa application.

For example it is very common for someone to take out a long study visa (say 3 years). During this period, they develop a relationship with a partner and want her to stay. Provided you meet the de facto requirement it may be possible, but it is significantly more difficult. For more information have a read here

If my partner and I have not lived together, can they be included on my student visa?
Most likely not, as you do not meet the de facto requirement.
