Dual Agency in Real Estate
Dual agency in real estate is a topic that most agents would prefer to avoid. Why is that?
Dual agency occurs when one agent represents both the buyer and seller in the same transaction. It also occurs when the buyer and seller are represented by two different agents who work for the same brokerage.
In Minnesota, dual agents are prohibited from acting exclusively for either party and may not advocate for one party to the detriment of the other. In other states, the entire practice of dual agency is simply illegal.
With such potentially detrimental consequences, why would anyone ever agree to dual agency in the first place?
Many agents will give the explanation that dual agency is simply a necessary evil. In my opinion, dual agency can, indeed, be evil - but it is definitely not necessary!
