Case Overview: The case involved Kulwant Singh, a junior engineer who was excluded from the Departmental Promotion Committee (DPC) meeting despite meeting the eligibility criteria. The court found the exclusion violated his fundamental right to be considered for promotion.
Legal Background: Rooted in Articles 14 and 16(1) of the Indian Constitution, the right to be considered for promotion ensures equal opportunity in career progression. The High Court ruled that Singh’s exclusion was a violation of his personal right, which is also supported by previous Supreme Court judgments.
