Amendment 74- Compensation for takings of property

This is a ballot initiative seeking to amend the Colorado State Constitution as it relates to the fair market value of property takings by the government. On the panel arguing for the Amendment are Marc Arnusch, a board Member of the Colorado Farm Bureau, and Patti Kurgan, a member of the Leadership Council in the Colorado branch of the National Federation of Independent Business. Arguing against Amendment 74 are Denver City Councilwoman Debbie Ortega and Colorado State House Majority Leader, KC Becker.

If the amendment were to pass, the language in the constitution would read: “Private property shall not be taken, of damaged, OR REDUCED IN FAIR MARKET VALUE BY GOVERNMENT LAW OR REGULATION for public or private use, without just compensation.”

Debbie and KC raise the potential issue that this measure is too vague and could end up becoming a burden on the courts.

Marc and Patti point out that farmers, small business owners, and individuals without a lot of ability to litigate against the government need their rights to own personal property protected against the government further than the constitution currently does.
