What to do when a competitor steals your content and outranks you in Google with it

A couple of months back I had noticed that a new competitor of mine had overtaken me in the SERP on a keyword. I had the snippet for about a year or so and this site comes out of no where and outranks me. In their article the keyword in question was a subheading whereas in mine the keyword was the article title, which made it even more frustrating. From what I could tell though, he/she had started the site on a 20 year old expired domain and have been outranking a lot of sites.
