Dacoity and Robbery | Day 7 of #BNS77 | IPC to BNS | Criminal Laws India
Robbery and Dacoity under IPC
Section 390 of the Indian Penal Code (IPC) - Robbery:
- Robbery is defined as an aggravated form of either theft or extortion.
- Theft becomes robbery if, during the act of theft or while carrying away stolen property, the offender voluntarily causes or attempts to cause death, hurt, or wrongful restraint to any person.
- Extortion becomes robbery if the offender, in the presence of the victim, puts them in fear of instant death, hurt, or wrongful restraint, and thereby induces them to deliver the property.
Section 391 of the Indian Penal Code (IPC) - Dacoity:
- Dacoity is defined as robbery committed by five or more persons conjointly.
- If five or more persons cooperate to commit or attempt to commit robbery, or are present and aid in its commission, they are all considered to have committed dacoity.
Robbery and Dacoity under Bharatiya Nyaya Sanhita (BNS)
Section 309 of the Bharatiya Nyaya Sanhita (BNS) - Robbery:
- The definition of robbery under Section 309 of the BNS remains largely consistent with the principles of Section 390 of the IPC, focusing on theft or extortion that is aggravated by the use or threat of violence.
Section 310 of the Bharatiya Nyaya Sanhita (BNS) - Dacoity:
- Similarly, the definition of dacoity under Section 310 of the BNS aligns with Section 391 of the IPC, emphasizing the involvement of five or more persons in committing robbery, with all participants held equally responsible.
The BNS seeks to modernize and clarify the language of these offenses while maintaining the core elements of robbery and dacoity as established under the IPC. The essential components, such as the use of violence or the threat thereof and the collective involvement in dacoity, remain integral to these definitions.
